Terms of Service

Welcome to CubeCast. These Terms of Service ("Terms") govern your access to and use of the CubeCast platform, website, and services (collectively, the "Service"). Please read these Terms carefully before using our Service.

By accessing or using CubeCast, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Definitions

  • "CubeCast," "we," "our," or "us" refers to CubeCast and its operators.
  • "User," "you," or "your" refers to any individual or entity that accesses or uses the Service.
  • "Content" refers to any images, text, videos, audio, or other materials uploaded, posted, or transmitted through the Service.
  • "Cube" refers to the interactive 3D content experiences created using our platform.

2. Account Registration

2.1 Account Creation

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

2.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

2.3 Age Requirements

You must be at least 13 years old (or 16 in the European Economic Area) to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

3. User Content

3.1 Ownership

You retain all ownership rights to the Content you create and upload to CubeCast. We do not claim ownership of your Content.

3.2 License Grant

By uploading Content to CubeCast, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, distribute, publish, and process your Content solely for the purpose of providing and improving the Service. This includes:

  • Displaying your Content to other users (based on your visibility settings)
  • Creating thumbnails and previews
  • Optimizing Content for different devices and formats
  • Backing up and storing your Content

This license ends when you delete your Content or account, except for Content shared with others that they have not deleted.

3.3 Content Responsibility

You are solely responsible for your Content and the consequences of posting or publishing it. You represent and warrant that:

  • You own or have the necessary rights to use and authorize us to use your Content
  • Your Content does not infringe any third party's intellectual property or other rights
  • Your Content complies with these Terms and all applicable laws

4. Acceptable Use Policy

You agree not to use the Service to:

  • Upload, post, or transmit any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Upload Content that depicts or promotes violence, self-harm, or illegal activities
  • Upload Content containing nudity or sexually explicit material without appropriate age restrictions
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
  • Upload Content that infringes any patent, trademark, trade secret, copyright, or other intellectual property rights
  • Upload Content containing viruses, malware, or any other harmful code
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service
  • Use the Service to send spam or unsolicited communications
  • Harvest or collect user information without consent
  • Use automated means to access the Service without our permission

5. Intellectual Property Rights

5.1 CubeCast Property

The Service, including its original content (excluding User Content), features, functionality, design, and underlying technology, is and will remain the exclusive property of CubeCast and its licensors. The Service is protected by copyright, trademark, and other laws.

5.2 Trademarks

The CubeCast name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of CubeCast. You may not use such marks without our prior written permission.

5.3 Copyright Infringement

We respect the intellectual property rights of others. If you believe that any Content on the Service infringes your copyright, please contact us at legal@cubecast.io with the following information:

  • A description of the copyrighted work you claim has been infringed
  • The location of the infringing material on our Service
  • Your contact information
  • A statement that you have a good faith belief that the use is not authorized
  • A statement that the information is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

6. Subscription and Payments

6.1 Free and Paid Services

CubeCast offers both free and paid subscription tiers. Features and limitations vary by tier and are described on our pricing page.

6.2 Billing

If you purchase a paid subscription, you agree to pay all fees associated with your selected plan. Fees are billed in advance on a monthly or annual basis, depending on your selection.

6.3 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. We do not provide refunds for partial billing periods.

6.4 Price Changes

We reserve the right to modify our pricing at any time. We will provide reasonable notice of any price changes before they take effect.

7. Termination

7.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination, your right to use the Service will immediately cease.

7.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

7.3 Effect of Termination

Upon termination, we may delete your account and Content. We are not obligated to retain or provide you with copies of your Content after termination, so we encourage you to maintain your own backups.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

  • The Service will function uninterrupted, secure, or available at any particular time or location
  • Any errors or defects will be corrected
  • The Service is free of viruses or other harmful components
  • The results of using the Service will meet your requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CUBECAST, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all claims exceed the amount you paid us, if any, during the twelve (12) months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless CubeCast and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party right, including intellectual property rights
  • Any Content you upload to the Service

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CubeCast operates, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation is unsuccessful, the dispute shall be resolved through binding arbitration or in the courts of competent jurisdiction.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

13. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and CubeCast regarding the Service and supersede all prior agreements.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
